We place an enormous level of trust in our doctors, and they are the ones we turn to when our lives and our livelihoods hang in the balance during a medical emergency. All it takes is one careless error on their part, and our lives can be changed forever.

Medical negligence is the failure of a medical professional to provide an expected level of care, resulting in harm caused to a patient. It can take different forms, from misdiagnosis and surgical errors to birth injuries and medication errors. Ultimately for a medical error to constitute negligence, it must be shown that the provider violated the duty of care owed to you as a patient. This means that a medical provider (doctor, nurse, physician’s assistant, etc.) did something WRONG. 

Doctors and other healthcare providers are required to abide by their professional standard of care and the law.  Sometimes injuries that you suffer following a medical procedure or treatment does NOT automatically constitute medical negligence. You must prove through expert opinions that a mistake was made by your provider. 

Medical negligence is not always obvious, but the effects can be devastating. It can take many forms, including:

• Surgical errors: Mistakes made during surgery can be deadly. They could include damage from a surgical instrument, as well as sponges or surgical instruments left within the body after a procedure.

• Failure to diagnose cancer: As the odds of successfully treating cancer diminish the longer it develops, this can be tragic.

• Misdiagnosis: An error in diagnosis means the condition will continue untreated.

• Anaesthesia errors: Anaesthetics are power substances that can do great harm if administered improperly. An error in dosage can lead to brain damage or death.

• Overprescribing prescription drugs: A simple error in prescribing a drug could mean an overdose or a wrong prescription from a pharmacy can lead to serious consequences.

• Errors during childbirth: These tragic cases of negligence often result in defects that may impair a child for life or even worse!
